Moottoripyöräilijät lainsuojattomia Norjassa

Norjalainen oikeusistuin tuli siihen tulokseen, ettei autoilijaa voida pitää vastuullisena jos hän sattuu ajamaan moottoripyöräilijän päälle. Eihän niitä nyt voi mitenkään huomata normaalia huolellisuutta ja varovaisuutta noudattaen!
Ns. "Suomen malli" on leviämässä pohjoismaiseksi?

In Norway, a car driver was recently acquitted in court after running down and seriously injuring a young motorcyclist - because the driver hit a motorcycle and not a car!

Norwegian riders are mad as hell. You should be too because this is something that affects your fellow rider - even if he's in another country. The Norwegian Motorcyclists' Union is on the case, demanding that the State Attorney appeals the verdict.

The rider had his ancle crushed, his elbow broken and sustained a number of wounds after the car hit him. He was hospitalized for 13 days and had to be on a sick leave for two months. In the District Court, the two judges concluded that the car driver took all the due care one could expect in the situation. Hence, she was acquitted.

The Norwegian Motorcyclists' Union warns that the reason for the acquittal is downright dangerous, if the verdict stays as it is. The two lay judges are basing their stance on the claim that the car driver did all she could to take due care, and that the accident happened because a motorcycle is harder to spot than a car. With this, the majority of the court is actually claiming that the Road Traffic Act's requirement for taking due care may be graded, which in NMCU's view is an extremely dangerous signal to send to Norwegian car drivers.

Tuomareiden mielestä auton kuljettaja toimi tilanteen vaatimalla varovaisuudella ja tarkkaavaisuudella, ja koska moottoripyörä on autoa vaikeampi havaita, vapautettiin auton kuljettaja syytteistä. Käytännössä siis peruste oli juuri tuo.

Sanomattakin pitäisi kai olla selvää ilman asian pähkäilemistä oikeudessa, ettei liikenteessä ole käytetty riittävää varovaisuutta mikäli onnettomuus syntyy.

Ihan tarkkaan tuolla tekstissä ei tapahtunutta yksilöity, tässä kuitenki kaks tekstistä poimittua lausetta jotka kertoo tilanteesta:

Auton kuljettaja ei siis antanu risteyksessä tietä moottoripyörällä ajaneelle, eli joko tuli eteen väistämisvelvollisuudesta huolimatta tai ajo suoraan päälle. Koko teksti on luettavissa täällä.

Nyt sitten kaikki vaan jyräämään oikeen urakalla mummoja ja polkupyöräilijöitä kun jos ihmissilmällä ei näe prätkää nii noita on jo täysin mahdotonta havaita...

Pumpataan öljyä, kuristetaan turskaa, tehdään (jopa hyvää) heavy-musaa ja tapetaan siinä sivussa muutama motoristi, ihan vaan kun ei huomattu.. eips siinä mittään, nyt siellä ei tarvi autoilijoiden tiirata sitä vähääkään, kun on ennakkotapauskin asiasta. Ei niitä pärriä ja kuskeja näe, ei sitten millään.

Toisaalta, se vanha viisaus -> "ajattele itsesi näkymättömäksi". Tuo pitää hengissä, tai ainakin antaa lisää mahdollisuuksia.

Täähän olisi kanssa "hauska" juttu:
Autoilija ajoi pyöräilevän lapsen yli, vapautettiin syytteistä kun lapsi on niin matala ja kapea, ettei häntä voi havaita.

Outoa kylläkin tuollainen Norjassa, jossa mielestäni on kohtelias, huomaavainen ja kurinalainen liikenne. Ylinopeuskin on tappoa suurempi rikos.
Eiköhän tuo päätös kumota; tuohan on täysin mahdoton ennakkotapaus.
